A whistleblower's wrongful termination lawsuit, an alleged kickback arrangement, and a conviction in China carrying a life sentence are the three court cases now central to WPP's legal troubles, Adweek reports. All three trace back to an alleged rebate practice carried out by WPP executives for years through media buying arm GroupM, now rebranded WPP Media. Rebates are lawful in many contexts and widely accepted in some jurisdictions. The Anti-Kickback Statute makes the practice illegal when an agent keeps the money without the client's knowledge and consent.

Rebate clauses in media contracts face fresh scrutiny as a result, with clients newly pushed to demand documentation on where rebate dollars land. Agencies within the WPP network face renewed pressure to disclose rebate arrangements clearly, since the legal line between a lawful rebate and an illegal kickback rests entirely on whether the client knew and agreed. Any advertiser without an audit clause in its media contract shares the exposure these three cases have now put on public record.
